Description
The seminar "Political Constitutional Law" examines the role of constitutional law and constitutional courts at the intersection of law and politics. Constitutional law is a "law for politics": on the one hand, it regulates the competition for political decision-making power; on the other hand, it limits the scope of the political decisions made within the framework of democratic competition, both in terms of content and form. Particularly in Germany, political decisions are increasingly "juridified" through the Basic Law (GG) and its interpretation by the Federal Constitutional Court (BVerfG). Traditionally, all major political decisions and societal conflicts in the Federal Republic are subject to constitutional review by the BVerfG. The court has been and continues to be a significant actor in the political development of the Federal Republic of Germany (BRD). This role of the BVerfG has long been a source of criticism, with claims that the BRD is on the path to becoming a "jurisdictional state" and that the BVerfG is an "unbounded court."
